Copyright Terms and Usage Agreement

Usage Rights:

The client is granted personal usage rights to the images provided. These rights allow the client to use the images for personal and promotional purposes only, including but not limited to printing, sharing on social media, as well as institutional and personal websites.

Commercial usage and usage through third party requires additional permissions.

Modifications:

The client may not alter or modify the images in any way without permission from the photographer. This includes cropping, editing, retouching, AI alterations, or adding filters to the images. 

Grant of Rights:

Client grants Photographer, Shahriyar Farshid, the irrevocable and unrestricted right to use and publish the photographs taken, for any lawful purpose worldwide and in perpetuity, including but not limited to, advertising, promotion, social media, portfolio, exhibitions, grant submissions, and photography competitions.

Release and Hold Harmless Agreement:

Client hereby releases, discharges, and agrees to hold harmless Shahriyar Farshid, his agents, legal representatives, and assigns, from any and all claims, demands, or causes of action that may arise due to this authorization or the use of these photographs, including but not limited to any claims of libel, invasion of privacy, or violation of the right of publicity.

Attribution Requirement:

When sharing the images on social media, websites, or other public platforms, the Client agrees to credit Shahriyar Farshid as the photographer by including “© Shahriyar Farshid” alongside the images. Proper attribution is essential for protecting the Photographer's copyright and intellectual property rights.

Duration and Conditions of Rights:

The personal usage rights granted to the Client are non-transferable and intended solely for the Client’s personal use. Photographer reserves the right to revoke these usage rights in cases of copyright infringement, unauthorized distribution, or any violation of this agreement by the Client. Any revocation of rights shall be communicated in writing.

Copyrights of Images:

All images captured during the portrait photography session are the intellectual property of Shahriyar Farshid and are protected by copyright law.

Safety

Waiver of Liability for Injury:

Client hereby releases and holds harmless Shahriyar Farshid, Flatverse Studio, and any affiliated agents from any and all liability for injuries, damages, or losses that I may sustain during the photography session. Client agrees that this waiver extends to any physical injuries that may arise from being in or around the studio or interacting with the photography equipment.

Client Responsibility for Safety and Release of Liability:

The Client acknowledges and accepts full responsibility for their personal safety and the safety of any musical instruments, equipment, or belongings while on the studio premises. The Client agrees to take appropriate measures to safeguard their own physical safety and handle any equipment or instruments responsibly. The Photographer assumes no liability for any accidents, injuries, loss, or damage to the Client’s person or property that may occur on the premises. By signing this agreement, the Client releases and holds the Photographer harmless from any claims or demands resulting from accidents or injuries incurred during the session.

Assumption of Risk:

The Client acknowledges that the studio environment contains photography and lighting equipment, including but not limited to cables on the floor, tripods, and hot lighting equipment, which may pose inherent risks. The Client recognizes these potential hazards and voluntarily assumes full responsibility for their own safety while in the studio. The Client agrees to exercise caution around all equipment to prevent trips, falls, burns, or other accidents.

Children in the Studio:

If children are present in the studio, the Parent or Guardian agrees to prepare them in advance by instructing them not to touch, move, or interfere with any objects or equipment in the studio space. The Parent or Guardian must be present at all times during the session and assumes full responsibility for the child’s safety and behavior. The Parent or Guardian agrees to hold the Photographer harmless and voluntarily releases any claims or demands against the Photographer arising from the child’s actions, conduct, or any incidents while on the studio premises.
